An off-duty agent's assault on a senior citizen exposes the danger of an over-funded, under-trained agency that views immigrant communities as battlefields rather than neighborhoods.
Imagine waking up at 3:30 am to find a stranger sleeping on your grass. For one 72-year-old man in Fresno, that stranger was David Gonzalez. He was not just a trespasser. He was a 32-year-old federal agent from Texas assigned to Immigration and Customs Enforcement. When the homeowner told him to leave, Gonzalez did not go quietly. He was drunk and agitated. He attacked the old man and then attacked the man's daughter. This is la pesadilla—the nightmare of a man with a badge who thinks the world is his footstool.
A badge is not a license to assault
The details are as ugly as the act. According to KMPH Fox 26, Gonzalez pushed the daughter into a parked car, leaving dents in the metal. He forced the 72-year-old man to the ground. The father did what any of us would do to protect our children. He grabbed a legal gun and shot Gonzalez in the midsection. The Fresno Police Department says the father is not facing charges. He feared for the safety of himself and his daughter.
Some will argue that this was a personal tragedy. They will say Gonzalez was off-duty and alone. They will claim a struggle with alcohol is not the fault of the government. Internal records show a dangerous shortcut. ICE cut 240 hours from its basic training program. They slashed 56 hours of firearms training. They cut almost all fitness training. They are sending men into our streets who have not been taught how to handle a crisis or a citizen. They are producing agents who are all power and no discipline.
The architecture of impunity
The most telling part of this desmadre happened after the shooting. Councilmember Miguel Arias told ABC30 Fresno that ICE allegedly asked the police to release Gonzalez into their custody from the hospital. Fresno Police Chief Mindy Casto denied this request was made. But the mere rumor of it reveals the agency's heart. They wanted to pluck their man out of a local jail and hide him in a federal shadow.
This is the mechanism of the Homeland Security Act of 2002. That act reorganized the government to empower agents to operate with a sense of impunity in vulnerable communities. It turned our neighborhoods into zones of occupation.

Justice requires that he be tried in a Fresno court, not shielded by federal supremacy. The Department of Homeland Security must waive any immunity and let the local law handle its own. Anything less is just another lesson in impunity.
