This is a fundamental misuse of the law. Trump is wrong because he is using the form of due process to destroy the substance of institutional independence.

A checklist for the firing squad

The current crisis is a response to a judicial defeat. Last summer, Trump moved to fire Cook over allegations that she misrepresented information on mortgage applications. In June 2026, the Supreme Court ruled that Cook could remain in her post. As Axios reports, the Court found the administration failed to give Cook adequate notice and an opportunity to respond.

Now, the president has created a new process. Politico reports the committee is tasked with investigating whether Cook made "false statements in connection with one or more mortgage instruments." This is a narrow focus. It is designed to find "cause" for removal. In the context of independent agencies, "for cause" is a statutory restriction. It means a president cannot fire an official for political reasons. He must prove inefficiency, neglect of duty, or malfeasance.

If the allegations of mortgage fraud are true, Cook has no business on the board. A central bank cannot be led by someone who lacks basic integrity. But the process must be honest. Trump's new committee is not an honest search for a violation. It is a curated exercise in evidence gathering.

The architecture of the inquiry

The composition of this committee reveals its purpose. It consists of three executive branch officials. Kevin Hassett is the president's top economic aide. Keith Sonderling is the acting head of the Office of Government Ethics. Andrea Lucas is the Chair of the Equal Employment Opportunity Commission. CNBC notes that the presidential memorandum does not mention any outside or independent arbiters.

This is a closed loop. The committee consists of the accuser's subordinates. The White House memo requires Cook to appear at a closed-door hearing on November 5. G1 Globo reports the memorandum limits the hearing duration to a maximum of four hours. Cook may submit a final written response by November 10.

This is not a trial. It is a deposition conducted by the people who want her gone. When the process is controlled entirely by the party seeking the result, the result is predetermined.

The ghost of Humphrey's Executor

The Federal Reserve is not a cabinet office. It is an independent agency created in 1913 to keep monetary policy away from the whims of the White House. This independence is protected by the mechanism of Humphrey's Executor. In that 1935 case, the Supreme Court ruled that Congress may limit the president's power to fire leaders of independent agencies. The Court established that such officials can only be removed "for cause."

This rule exists because the president's interest in a specific policy outcome often conflicts with the public interest in stable, expert governance. Trump has described the Federal Reserve board as "hostile" because they refused to lower interest rates. He is now using a personal allegation to solve a policy disagreement.

By framing a policy fight as a fraud investigation, he attempts to bypass the protections of Humphrey's Executor. He is trying to turn a "for cause" protection into a "for any reason the president can document" protection.

The danger here is not just to Lisa Cook. It is to the tool itself. If a president can manufacture "cause" through a hand-picked committee of aides, then "for cause" means nothing. It becomes a mere suggestion of procedure.

The committee will likely conclude its hearings and recommend "cause" for Cook's removal by mid-November. This will almost certainly prompt a new injunction request in federal court. The Supreme Court will eventually have to decide if a closed-door hearing run by the White House satisfies the due process mandated in June. If the Court accepts this theater as sufficient, it will signal that the independence of the Federal Reserve is a fiction. The result will be a central bank that serves the president's polling numbers rather than the nation's economy.
